Victoria en Victoria (en homenaje a Jarillo)

A finales de noviembre pasado falleció uno de los dos creadores de este blog, Jarillo.

En el blog de la FEN, como en muchos otros sitios, le dediqué un homenaje personal titulado "Juan José López Jarillo, mi amigo revolucionario"
Hoy me atrevo a reabrir este blog en el que ahora me encuentro sólo, para retomar y finalizar la lucha que empezamos él y yo en Cádiz contra la Ordenanza nudófoba.
La noticia lo merece:
Tras la aprobación de la ordenanza Jarillo junto a otros dos activista y sus familias, se plantaron el "día sin bañador" en la playa de la Victoria en el uso de su derecho de manifestación y de protesta contra la ordenanza y fueron multados.
Hace unos días ha salido la primera resolución y no sólo se nos ha reconocido ese derecho, sino que el "día sin bañador" queda definitivamente protegido.
La obligación de "notificar" las manifestaciones tiene por objeto que la autoridad decida si debe poner un dispositivo policial para proteger la manifestación o debe cortar calles, etc. Por ello no se puede aplicar a una convocatoria de carácter general (en todos los lugares públicos de baño) y que es evidente no necesita protección policial. Ello nos evitará tener que notificar infinitos lugares a todos y cada uno de los gobiernos civiles de los más de 8000 ayuntamientos de España.
La sentencia dice:

Es evidente que la norma prohíbe el desnudo en la zona de la playa donde se produjeron los hechos denunciados, pero también lo es que este hecho no tenía como objetivo la infracción de la norma municipal, sino el ejercicio del derecho de manifestación y expresión conforme a una convocatoria nacional, según ha quedado debidamente acreditado, de su oposición a la citada regulación, reivindicando el derecho a la desnudez en las playas sin limitación. 

Pues bien, sin perjuicio de la bondad o no de la reivindicación, que en cualquier caso tiene plena cabida en una sociedad democrática, y de la obligación de todos los usuarios de las playa de cumplir las normas que regulan su uso, así como del derecho a impugnarlas, o a manifestarse contra las mismas, lo cierto es que los hechos denunciados se encuadran en esa convocatoria nacional y por ello en el ejercicio de los derechos fundamentales, no concurriendo los elementos indispensables del tipo impositivo, por lo que procede la estimación del recurso y la anulación de la sanción impuesta.

Y termina diciendo:
Esta sentencia es FIRME, y NO cabe contra ella RECURSO ordinario alguno.

En breve el nuevo ayuntamiento de Cádiz, además, retirará la ordenanza y estaremos en una posición mejor que antes de la ordenanza al haberse realizado al menos dos acciones a nuestro favor: esta sentencia y la retirada de la ordenanza, que es un reconocimiento a nuestra tesis, las de la libertad de vestimenta.

El hombre feliz no tenía camisa

Algunos ayuntamientos, como el de Barcelona, quieren limpiar las calles de descamisados. Esos turistas con calentura, generalmente incapaces de quitarse la corbata en sus países de origen, pero que aquí se dejan hasta la piel a tiras de lechoncillo rosado, semidesnudos por la calle, robando más sol del que compraron en su paquete turístico. Muchos han tomado como uniforme de turista la exhibición de sus barrigas cerveceras, de pechos colgantes alimentados con pollos hormonados (como avisaba Evo Morales), unos tatuados, otros con la piel satinada de sudor agrio, todos con la sensación dibujada en el rostro de que pasean entre aborígenes españoles a los que hay que fotografiar compulsivamente como recuerdos de caza.

En el ayuntamiento barcelonés lo consideran una falta de respeto y de higiene, a un tiempo. Y, sobre todo, de estética, como una imagen fuera de contexto. Porque si extraño resulta un bañista vestido de frac al borde de la playa, más lo es la imagen de una terraza de la Diagonal ocupada por bañistas ingleses tomando baños de sol y cervezas, por ese orden.

El contexto es la clave. En los comienzos de las playas nudistas de Cádiz, en los años setenta, sólo nos sentíamos verdaderamente desnudos cuando llegaba la Guardia Civil, vestida de verde tergal, a pedirnos los carnés. Cierto es que ante aquellos civiles predemocráticos siempre te sentías desnudo, aunque vistieses una trenka de grueso paño.

Al parecer, José Bono, preocupado por las buenas maneras y la estética, a partes iguales, ha dado orden a sus ujieres de no dejar entrar en el Congreso a nadie con chanclas o bermudas. Aunque, a tenor del comportamiento de algunos diputados del PP, no sería precisamente la vestimenta la que estaría fuera de contexto en tan solemne lugar.

Das Wichtigste ist ausziehen der Verstand. Ausziehen es von Vorurteilen zu sehen die Dinge natürlich und wie sie sind. Gibt es keine sklaverei radikaler als die Konzepte. Ausziehen Der Geist ist, aus ihm die Kleidung von der Sprache, der Gedanke, der Geschichte, der Würfel, den Mut zu leben, die Freiheit der neue und kreative Leben entdecken alle Zeit alles, was wir können.

Am 12.
